British Overseas Territories Citizens from Hong Kong who did not register as British Nationals (Overseas) and had no other nationality or citizenship on 30th June 1997 became British Overseas Citizens on 1st July 1997.

Thereafter, the BNO Visa can be extended for a further 30 months. After attaining 5 years of continuous residence in the UK, British Nationals (Overseas) on this Visa category will be eligible to apply for Settlement in the UK. After 12 months of Settlement in the UK, British Nationals (Overseas) can apply for British Citizenship.

FAQs
What is the British National (Overseas) visa for Hong Kong residents?
The British National (Overseas), or BN(O), visa is a UK immigration route for people from Hong Kong who hold BN(O) status, as well as certain eligible family members. It allows successful applicants to come to the UK to live, work and study, and it is designed as a long-term route rather than a short visitor category. Applicants can usually apply from overseas, and the route can lead to settlement later if the residence requirements are met.
This visa is often important for families who want a more stable future in the UK. It offers flexibility because it is not tied to a single employer or a particular course of study. Garth Coates can assist with eligibility checks, document preparation, and building a clear application where the family circumstances or immigration history need careful explanation.
Who can apply for a BN(O) visa from Hong Kong?
A person can usually apply if they hold British National (Overseas) status and are ordinarily resident in Hong Kong, the UK, the Channel Islands or the Isle of Man. Certain family members may also be able to apply with them. GOV.UK also states that a child of a BN(O) aged 18 or older and born on or after 1 July 1997 can apply separately from their parent, and their own family members may be able to join them.
This makes the route especially useful for family relocation. Depending on the case, eligible family members can include a partner and children, and the rules can extend further in some household situations. Because the exact category matters, it is important to confirm eligibility carefully before applying. Garth Coates can help families understand whether they should apply as a BN(O) status holder, a household member, or under the newer adult child arrangements.
What documents are needed for a BN(O) visa application?
A BN(O) visa application should include documents that prove identity, residence, and eligibility under the route. In many cases, the Home Office will check BN(O) status directly, but applicants still need to provide supporting evidence for other parts of the application. This can include proof of ordinary residence, evidence of the family relationship where relatives are applying, and documents showing the family can support themselves financially if required.
Useful documents may include:
- A valid passport
- Proof of current residence
- Birth or marriage certificates where family members are included
- Financial documents if maintenance must be shown
- Tuberculosis test results, where required
A well-prepared application depends on the documents fitting together clearly. Garth Coates can help organise the evidence and reduce the risk of gaps or inconsistencies that may delay a decision.
How long does a BN(O) visa last?
Applicants on the Hong Kong BN(O) route can generally apply for permission for either 2 years and 6 months or 5 years. This gives families some flexibility in how they plan their move to the UK. A longer grant may suit those who want a more stable long-term arrangement from the outset, while a shorter period may work for some applicants depending on their circumstances and budget.
The route is also attractive because it provides a pathway to settlement. After completing the necessary residence period in the UK, many visa holders can move on to the next stage if they still meet the requirements. Choosing the right application length can therefore be part of a wider immigration strategy. Garth Coates can advise on which option is more suitable based on family plans, finances, and long-term settlement goals.
Can you work and study in the UK on a BN(O) visa?
Yes, the BN(O) visa allows successful applicants to live, work and study in the UK. Home Office guidance states that people granted entry clearance or permission to stay on this route can work in almost any capacity, which makes it much more flexible than many employer-sponsored visas. It is also suitable for families who want access to education while building a longer-term life in Britain.
This flexibility is one of the main advantages of the route. It can suit professionals, self-employed people, families with school-age children, and adults who want to continue their studies while living in the UK. Garth Coates can help applicants understand how the visa fits with work plans, family relocation, and future settlement so that the application supports both immediate and long-term goals.
Can a BN(O) visa lead to settlement in the UK?
Yes, the BN(O) visa can lead to settlement in the UK. GOV.UK states that a person may apply for settlement after 5 continuous years in the UK on this route. The earliest point to apply is 28 days before completing the full 5-year period. In most cases, applicants must also meet the continuous residence rule, which usually means spending no more than 180 days outside the UK in any 12-month period.
Settlement is a major milestone because it gives a stronger long-term status in the UK and can later support a British citizenship application if the wider nationality requirements are met. Families should therefore keep careful records of travel and immigration history throughout the visa period. Garth Coates can help with both the initial BN(O) visa and later settlement planning so the route is managed properly from the start.
Can adult children of BN(O) status holders apply independently?
Yes. The UK government announced in February 2026 that adult children of BN(O) status holders who were under 18 at the time of Hong Kong’s 1997 handover can apply independently of their parents under the expanded route. Their partners and children can also apply with them. The government said this expansion could allow around 26,000 more people to come to the UK over the next 5 years.
This is an important change because it broadens access for families whose circumstances no longer fit the earlier structure of the route. It may be especially relevant where adult children now have partners or children of their own and want to make a separate application. Because this expansion is relatively recent, it is sensible to get up-to-date advice before applying. Garth Coates can help families assess whether they qualify under the newer independent adult child route.
How can Garth Coates help with a BN(O) visa application?
Garth Coates is a UK immigration law firm specialising in immigration law and citizenship matters. For BN(O) visa applications, legal support can be valuable where applicants need help understanding eligibility, presenting proof of residence, preparing family-member applications, or planning for settlement after arrival in the UK. The firm’s immigration focus and experience can be particularly useful where a case is time-sensitive or the family structure is more complex.
A well-prepared application is often easier for the Home Office to assess and can reduce the risk of delays caused by unclear evidence. That can matter a great deal where several family members are applying together or where the applicant wants to align the first visa application with a long-term settlement plan. Garth Coates can support clients from the initial eligibility stage through to submission and later immigration steps in the UK.
