A UK Spouse Visa is a type of family visa that allows a husband, wife or civil partner of a British citizen or a person who is settled in the UK to live together in Britain. It is designed for couples who want to build their life in the UK on a lawful long-term basis rather than through short visits. The route can also apply in some cases involving a partner with refugee status or humanitarian protection.

To qualify, the relationship must be genuine, the marriage or civil partnership must be legally valid, and the applicant must meet requirements linked to finances, English language ability and accommodation. In some cases, people already in the UK on another visa may be able to switch into the family route before their current permission expires, although visitors are usually not allowed to switch from inside the UK. Yes, many applicants need to prove their knowledge of English when applying for a UK Spouse Visa. This is a standard part of the family visa route unless an exemption applies. Some people do not need to meet the English language requirement, including applicants over 65, people with certain physical or mental conditions, and some applicants who have already been in the UK on a family visa for the required period when extending.

English can often be proved through an approved English language test, a degree taught in English, or nationality from an eligible English-speaking country, depending on the rules. Choosing the wrong form of evidence can cause unnecessary problems, even where the applicant clearly speaks English well. Processing times for a UK Spouse Visa depend on where the application is made. According to GOV.UK, applications made from outside the UK usually receive a decision within 12 weeks. Applications made inside the UK usually take 8 weeks if the applicant meets the financial and English language requirements, although some applications can take much longer if those requirements are not met or if the case is more complex. Faster services may be available in some situations.

As a route to longer-term residence, a Spouse Visa can eventually lead to settlement. GOV.UK says the earliest point at which many applicants can apply for indefinite leave to remain is after 5 years of continuous residence on a family visa as a partner. In some cases, yes. A person already in the UK on another visa may be able to switch into the family visa route before their current permission expires. However, there are important exceptions. People in the UK as visitors, or on permission granted for 6 months or less, usually need to leave the UK and apply from overseas instead. One key exception is where someone is in the UK on a fiancé, fiancée or proposed civil partner visa, in which case switching inside the UK may be possible after the marriage or civil partnership takes place.
